So, I repeat, what percentage cut are you giving the band?



I wouldnt mind giving 50% to the band, I mean its not an issue. As I am planning on giving 30% to a charity. This'd mean I get 20%. But Its all good. Its not a "serious business" or anything, just something to do on the side.


Well if this illegal business of yours was brought to the attention of the band you would be paying 100% of your profits to them, plus their legal fees and additional damages.

But don't worry about being sued. Seeing as you're only 15, your parents will be the ones forfeiting their life savings and future wages to pay for your mistake, so you won't lose anything other than your profits.

Finally, you are obviously too focused on the band's "we don't care if you make merchandise because we love all our fans" attitude. If the band were to find out about your operation they would more than likely not care, in fact they would probably be happy for you. However, their management are the ones who would nail you with legal cases. The managers are the ones getting most of the money the band makes, so it is in their interest to sue anyone who takes away from their pay slip.

I would strongly advise you stop selling your products. Wear them yourself as fan art

Of course, as you'll have permission from the rights holder.

Make sure to get any contracts in writing though.

An oral agreement is a legally binding contract (as long as you can prove it exists) i.e. the band and you verbally agreeing that you'll make your product with their permission, percentages of profits, division of operating costs etc. To get that in writing...just write down what was said and both parties sign and date under the main text. Anything below the signatures is not legally binding.
