I'm going to sound like a bit of an idiot here but I haven't done factions in a while. Do factions still have the ability to surrender? (if so, How) or has that been eradicated now?

You can end a war by setting up a NAP through trade with the opposing leader.

hey bogie..

i sent an NAP like 2 days ago (while i was at my faction) to their leader, we both completed the trade, also in the faction news it said the war was over and nap was accepted etc..

but in my wars it still showed we were warring against that faction for some reason, is that a bug? or have i done something wrong?

I've got no reference to go on as you've since left the faction, so I cannot answer that... If I were to guess I'd say you did a peace treaty rather than a NAP which resulted in the war expiring and counting as a 'failure', thus remaining on the warbase stated as such for 24 hours.

didn't know the difference between nap and peace treaty...

NAP = No war
Peace treaty = No attacks

That's pretty much the difference between the two.
